Inheritance Tax Planning

Currently, your family will typically pay 40% tax on any assets left when you die, once the Nil Rate Band of £325,000 is used up. If you are a married couple, or civil partners, then that allowance doubles if you leave everything to each other.

What is the Court of Protection

What is the Court of Protection? The Court is intended to provide a way of making decisions for people who are not considered mentally fit enough to make those decisions themselves. If you are mentally fit, and don't have a serious accident or illness in earlier life, you probably won't find the Court of Protection running your life until you are fairly old, and maybe not even then. Especially if you have taken precautions to avoid the potential problem.

No Last Will: What are the Rules of Intestacy?

The Rules of Intestacy apply where there is no Last Will and testament which is valid in England and Wales. The Rules of Intestacy also apply where a valid Last Will and testament does not dispose of everything the person owned. Their assets (the estate) must be shared out according to the Rules of Intestacy. A person who dies without leaving a valid Last Will is called an intestate person. This is a complicated area, so please just take this as an introductory article. You may want to use the link at the foot, especially if you are looking at an estate in Northern Ireland or Scotland, where we only operate through associated firms.
