Probate is the word usually used when discussing sorting out a deceased persons affairs in order to ensure that their liabilities are dealt with correctly and their remaining assets go to the right people. Probate is also known as administering the estate.
We can provide as much or as little help as you wish - why not call us now?
If you do not make a Will, then the Government have rules called the Rules of Intestacy which will decide where your assets will go. And it won't be what you would have wished in a lot of cases. And they often are not at all fair! See our site for more information at http://www.apww.co.uk/why-make-will/
Currently, your family will typically pay 40% tax on any assets left when you die, once the Nil Rate Band of £325,000 is used up. If you are a married couple, or civil partners, then that allowance doubles if you leave everything to each other.
If you are NOT married, then it it is just the £325,000. All this assumes you are UK domiciled!
We can save most people a fortune, so why not look after your family rather than the Taxman, and contact us today?
What is the Court of Protection? The Court is intended to provide a way of making decisions for people who are not considered mentally fit enough to make those decisions themselves. If you are mentally fit, and don't have a serious accident or illness in earlier life, you probably won't find the Court of Protection running your life until you are fairly old, and maybe not even then. Especially if you have taken precautions to avoid the potential problem.
The Rules of Intestacy apply where there is no Last Will and testament which is valid in England and Wales. The Rules of Intestacy also apply where a valid Last Will and testament does not dispose of everything the person owned. Their assets (the estate) must be shared out according to the Rules of Intestacy. A person who dies without leaving a valid Last Will is called an intestate person. This is a complicated area, so please just take this as an introductory article. You may want to use the link at the foot, especially if you are looking at an estate in Northern Ireland or Scotland, where we only operate through associated firms.
Our function is to introduce you to suitable professionals to help with the probate service.
For some people, that is just an hour or so's advice as the estate is straightforward.
Other folk want someone to do the whole job for them.
Other know there are going to be squabbles and it is safer to use an independent professional than risk family relationships.
Better off estates may need specialist tax planning advice.
In all cases, we do our best to refer you on to a suitable business which fits your needs.
