Avoid Court after Separation

When two people decide to separate, there are usually a number of other decisions that have been made about such issues as:

- How to separate
- What to say to the children
- Who will live where
- The distribution of money and property.

Mediation provides an opportunity for you to consider these matters together and with the help of a mediator, to decide jointly what you think are the best arrangements for you and your family.

Solicitors and the Courts encourage people to use mediation where possible to negotiate arrangements and reach decisions about their children and financial matters. It is generally quicker, cheaper and often produces more effective agreements when there is a need to sort out the practical aspects of separation.

The mediator will not takes sides, but help you concentrate on what is best for the future. What you say in mediation is confidential. Mediation can be quicker and cheaper than legal proceedings.

Mediation provides a safe neutral environment in which to discuss things, impartiality, in an organised and constructive manner by moving forward, reducing conflict and promoting co-operation.

Mediation is a confidential and voluntary process in which an impartial third part (the Mediator) helps you to discuss and negotiate all aspects of your divorce, separation, family breakdown, children and finances.

Having skilled Mediators who do not take sides and are sensitive to difficult issues.

Parents, divorcing couples, teenage parents, grandparents, adult siblings, parents & adult children, other members of the extended family where communication and/or relationships are problematic about future arrangements for children, property and finances.

In addition to all the other benefits of mediation the process is a cost effective way of resolving issues. You may qualify for Legal Aid to cover your costs during mediation and for the final documentation. If you do not qualify for Legal Aid the costs are worked out on an hourly basis, per person, at the end of each mediation session and for the preparation of final documentation.

Individual Assessment before Mediation

Assessment

You will be required to attend an assessment for the Mediator to provide you with information about the mediation process and assess the suitability of your particular issues for mediation. During the assessment your income will be considered and costs of the next stage of the process will be given to you. The anticipated number of sessions for your particular circumstances will also be discussed with you. The assessment lasts around 1 hour at the hourly rate of £95.00 (no vat).

In our experience issues for mediation are between 2 and 5 sessions which can last between 1 to 1 ½ hours. Our present hourly rate is £95.00 per person (no vat) payable at the end of each session. You will be provided with an estimate of the costs of your final documentation at the earliest opportunity.
