Notice of Intended Prosecution or Section 172 Notice

If you receive a Notice of Intended Prosecution or section 172 notice requiring you to name the driver of a vehicle at the time of an offence you may need to take legal advice immediately. An offence is committed if the notice is not returned within 28 days, regardless of whether or not you were the driver. This offence is now dealt with by a mandatory six penalty points being endorsed on your driving licence as well as a fine. There are defences available to a person accused of this offence.
